
The Case
On January 11, 2004, Nakia Sapp (victim) and Kimberly Smith (alleged victim) where robbed at gunpoint by two men; one black male robber and a white male robber. Both men were unknown to Nakia Sapp and Kimberly Smith.

At 8:30 pm, Nakia was asleep on the living room floor, a few feet away from the door of the residence. After dropping off her mother, Kimberly returned home awaiting a friend’s visit. Outside, two men approached the residence and begin knocking. Hearing the knock, Kimberly looked out her bedroom window to see who it was. She did not recognize the men. Kimberly went to the apartment door and opened it, to ask the men who were they looking for. At that moment, one of the men kicked the door open and both men forced their way inside.
Once inside, the black male robber pointed a gun in the face of Kimberly and pushed her on the sofa. Both men then focused their attention on Nakia, as he slept on the floor. The unknown black male pointed the gun in the face of Nakia, waking him up; threatening to kill him if he and Kimberly did not comply. The men demanded all the money inside the house. Nakia gave approximately $850.00. Meanwhile, Kimberly attempted to call 911. Being caught by the black male, she was forced to hang up the phone. Kimberly told the men her money was in her purse in her bedroom. The black male then forcibly took her to the bedroom and took approximately $200.00 from her purse.
While the robbery was taking place, a courtesy officer named Tammy Taylor McIntosh knocked on Kimberly’s door. The black male robber opened the door and spoke with the courtsey officer. Explaining to her that Kimberly and Nakia were fighting and he was trying to resolve the problem. Tammy asked to see Kimberly. At that time, both men ran out the apartment and into the woods. A short time later, Officer Brian Welch and responding Officer Barnes made contact with the white male. Officer Barnes advised the white male of his Miranda Rights. The white male confessed his involvement and the identified himself as Lloyd Scott. Lloyd told the Officers where his vehicle was located and gave permission to search. A search of the vehicle revealed miscellaneous paperwork identifying Anthony Walker. Lloyd stated that the paperwork in his vehicle belonged to the black male that committed the crime with him. Lloyd stated that he did not know the black male’s real name and that he only knew him by the name Tiger.

During this time, Officer Robert Shull recovered a 9 mm Ruger handgun at 460 Wilton Circle; in a utility closet under a hot water heater. That night, Officer Heather Smart showed both victims the handgun that was recovered. Both victims identified the gun as the gun the black male possessed inside the apartment. Kimberly and Nakia also identified Lloyd Scott as the white male that burglarized and robbed them. Both Kimberly and Nakia gave statements to Officer Heather E. Smart. Officer Smart also reported the crimes to Investigator Christopher Woehr.

Further investigations conducted by Investigator Woehr, revealed a viable suspect in Anthony Walker. Investigator Woehr developed a photographic lineup containing 6 images; 1 image of Anthony Walker and 5 images of black males.
On January 15, 2004, at approximately 7:05pm, Investigator Woehr made contact with Kimberly and showed her the photo lineup. She identified Anthony Walker as the black male that forcibly entered her residence, threatened her with a gun and robbed her. All evidence stated was presented to a jury and Anthony Walker was found guilty of the crimes charged.
